As the election draws closer, Biden orders that most illegal immigrants be blocked from crossing.

Ahead of the November election, Biden is anticipated to announce border actions as political tensions intensify.

Just months before the November election, the White House on Tuesday announced long-awaited executive moves to prevent illegal immigrants at the southern border from claiming asylum if crossings reach a specific level. These actions could soon face a court challenge from campaigners.

Once the average daily number of border encounters surpasses 2,500 over a seven-day period, President Biden is expected to issue a presidential proclamation that will temporarily halt the admission of non-citizens across the southern border, according to officials. That will remain in place for 14 days following a seven-day period during which less than 1,500 interactions occurred along the border. Immigration agents would find it simpler to swiftly remove people who do not have a valid reason to be in the country, according to officials in the U.S.

Fox has been informed by sources that there were 5,200 encounters at the border in the last 24 hours, and over 5,000 encounters per day on average during the previous week. At the southern border, there were 179,725 encounters in April 2023 as opposed to 211,992 in April 2023 and 189,357 in March. Even if those figures are below the peaks recorded in 2022 and 2023, they are still high when compared to the figures prior to 2021.

By doing this, Biden is utilizing his powers under the Immigration and Nationality Act (INA), namely sections 212(f) and 215(a), which provide presidents the ability to halt the entry of specific groups of foreign people. 212(f) was utilized by the Trump administration several times, notably for the travel ban from specific nations, however it was stopped by a a court case involving its application to the southern border.

There are few exemptions in President Biden's order for individuals entering the country. Visa holders, unaccompanied minors, victims of a "severe form" of human trafficking, anyone in immediate danger of harm to their life or safety, and those facing an acute medical emergency are exempt from this policy. Additionally, it does not apply to people attempting to enter the United States through ports of entry that accept the CBP One app; each day, about 1,500 migrants are permitted access.

It is anticipated to occur immediately, and the Departments of Justice and Homeland Security will jointly adopt a regulation limiting asylum eligibility during high border encounters.

It represents a notable shift in the Biden administration's policy towards the right. A number of border safeguards implemented under the Trump administration were reversed by the administration in 2021, which some claim fueled the subsequent massive influx of migrants. During Biden's presidency, there have been more than 7 million migrant crossings.

The administration claims that it is facing a dilemma that affects the entire hemisphere and that Congress must act to address the "broken immigration system" and provide resources. The White House claims that this move is in response to Republican rejection of previous attempts at congressional action, such as a bipartisan Senate plan that would have increased money and imposed a similar limiting mechanism.

"The interim final regulation and the presidential proclamation represent another crucial step in Prior to the announcement, a senior administration official briefed reporters on Tuesday about our more than three years of continuous efforts to increase our ability to impose consequences on people who cross our southern border.

"But we are clear eyed that today's executive actions are no substitute for Congress taking up and passing the tough but fair bipartisan Senate bill, which would have significantly strengthened the consequences in place at the border and, equally important, have provided billions of dollars to support the men and women who are working on the front lines to secure our border," they stated.

Republicans had previously asked the administration to use 212(f) to prevent illegal crossings, but lawmakers were not impressed and criticized the idea prior to the announcement was delivered too belatedly.

As far as I can tell, throughout his time as president of the United States, he has signed 94 executive orders. However, he has yet to take what he regards as effective action on the border, according to Sen. John Cornyn, a Republican from Texas, during a press conference. And if you were serious about doing it, why did you wait until now, is the question I have for him. He's not serious about guarding the border, is the straightforward response.

Other members said that, with only a few months to go before the election, Biden's handling of border security has left him looking cynical. According to a recent Fox News poll, 7 out of 10 Americans believe the White House has "mostly failed"in an effort to strengthen border security.
